Florida Charitable Registration Requirements

Unless exempt, a charitable organization must register with the Florida Attorney General before soliciting charitable contributions in Florida.

Out-of-state nonprofits that register under the Florida charitable registration laws are not required to qualify to do business in Florida. However, engaging in other business activities such as having an office or employees in Florida may trigger the requirement to register to do business in Florida.

  • Religious organizations
  • Educational institutions
  • Membership organizations
  • Solicitation for a single person
  • Political groups
  • Veterans organizations
Florida Charitable Registration Form:
  • Florida Charitable Organizations and Sponsors Registration Application, Form FDACS-10100 (Registration for Charitable Organizations), or
  • Small Charitable Organizations/Sponsors Application (for organizations with less than $25,000 in total revenue)
Florida Requires the Following Supporting Documents for Charitable Solicitation Registration:
  • Conflict of Interest Annual Certification
  • IRS determination letter
  • IRS Form 990, IRS Form 990-EZ, or the financial statement from the application form. If your nonprofit is new and has no financial history, you may submit a budget for the current year using the financial statement on the application form or your own form.
  • Audited financial statements by an independent CPA if contributions exceed $1 million; CPA review if contributions are $500,000 to $1 million
  • Professional fundraiser contracts (solicitors, fundraising counsel, and commercial coventurers)
  • List of officers, directors, trustees, and principal salaried executive staff (name, title, address, and phone).
